TERMS & CONDITIONS

1. Acceptance of Terms

By creating a Givaro account or using the Givaro application in any capacity, you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree to these Terms, you must not access or use the app. Your continued use of Givaro constitutes acceptance of any updates to these Terms.

2. About Givaro

Givaro is a gifting intelligence platform that helps users save items, track preferences, discover gift ideas, and understand personal taste patterns through a proprietary Taste Graph™ system. Givaro is designed to make gifting more thoughtful, personal, and effortless.

3. Eligibility

You must be at least 13 years of age to use Givaro. If you are under 18, you represent that you have obtained permission from a parent or legal guardian to use the app. Givaro reserves the right to terminate accounts where eligibility requirements are not met.

4. Account Registration

You agree to provide accurate, current, and complete information during registration. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify Givaro immediately at support@givaro.app if you suspect unauthorized use of your account.

5. User Content

You retain full ownership of all content you create or submit within Givaro, including saved items, notes, preferences, wishlists, and profile information ("User Content").

By using Givaro, you grant Givaro a non-exclusive, worldwide, royalty-free license to store, process, and analyze your User Content solely for the purpose of operating, maintaining, and improving the app and its features. This license does not permit Givaro to sell your User Content or share it with third parties in identifiable form.

6. Prohibited Conduct

You agree not to:

  • Use Givaro for any unlawful purpose or in violation of applicable laws
  • Attempt to reverse engineer, decompile, or extract the source code of any part of the app
  • Upload or transmit malicious code, viruses, or harmful content
  • Interfere with, disrupt, or circumvent the security or functionality of Givaro
  • Use automated tools to scrape, harvest, or collect data from the app
  • Impersonate any person or entity or misrepresent your affiliation with any person or entity

7. Aggregated & Anonymized Insights

This section is important. Please read it carefully.

Givaro may analyze user activity within the app to generate aggregated, anonymized insights that help improve the platform and may be shared commercially. These insights may include:

  • Gifting trends and seasonal patterns
  • Category and product preferences
  • Behavioral clusters and taste segments
  • Taste Graph™-level data (e.g., "People with X style preferences tend to favor Y gift categories")
  • Anonymous demographic and interest groupings

All such insights are created in a manner that cannot identify any individual user. Givaro applies industry-standard anonymization and aggregation techniques before any insight is used externally.

Givaro does NOT sell personal information. Aggregated and anonymized insights may be shared with brands, retailers, analytics partners, or other commercial parties for business and research purposes.

Opt-Out: You may opt out of contributing your anonymized activity to these insights at any time through Data Preferences in your app settings. Opting out does not affect your access to Givaro's features.

8. Third-Party Services

Givaro may integrate with or link to third-party platforms, services, and data sources. These integrations are governed by the terms and privacy policies of the respective third parties. Givaro is not responsible for the practices or content of any third-party service.

9. Intellectual Property

All content, branding, algorithms, the Taste Graph™ system, design elements, user interface, and underlying technology that constitute the Givaro platform are the exclusive intellectual property of Givaro and its licensors. Nothing in these Terms grants you any ownership rights in Givaro's intellectual property.

10. Termination

Givaro reserves the right to suspend or permanently terminate your account at any time, with or without notice, if you violate these Terms or engage in conduct that is harmful to Givaro, its users, or third parties. Upon termination, your right to access the app ceases immediately.

11. Disclaimer of Warranties

Givaro is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. Givaro does not warrant that the app will be uninterrupted, error-free, or free of harmful components.

12. Limitation of Liability

To the maximum extent permitted by applicable law, Givaro and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or other intangible losses, arising out of or related to your use of the app.

13. Changes to Terms

Givaro may update these Terms at any time. Material changes will be communicated through the app or via email. Your continued use of Givaro following notification of updates constitutes your acceptance of the revised Terms.
