1. Acceptance of Terms

By creating a Givaro account or using the Givaro application in any capacity, you agree to be bound by these Terms & Conditions ("Terms") and our Privacy Policy at givaroapp.com/privacy-policy. If you do not agree to these Terms, you must not access or use the app. Your continued use of Givaro constitutes acceptance of any updates to these Terms.

2. About Givaro

Givaro is a gifting intelligence platform, operated by Givaro LLC, that helps you save items, track preferences, discover gift ideas, connect with friends and family, and understand personal taste patterns through a proprietary Taste Graph™ system. Givaro is designed to make gifting more thoughtful, personal, and effortless.

3. Eligibility

You must be at least 18 years old to create a Givaro account. By registering, you confirm that you are 18 or older. Givaro may close accounts that do not meet this requirement.

4. Account Registration

You agree to provide accurate, current, and complete information during registration. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify Givaro immediately at support@givaroapp.com if you suspect unauthorized use of your account.

5. User Content

You retain full ownership of all content you create or submit within Givaro, including saved items, notes, preferences, wishlists, profile information, messages, posts, comments and photos ("User Content").

By using Givaro, you grant Givaro a non-exclusive, worldwide, royalty-free license to store, process, display and analyze your User Content solely for the purpose of operating, maintaining, and improving the app and its features, including showing your content to the members you have chosen to share it with. This license does not permit Givaro to sell your User Content or share it with third parties in identifiable form.

You are responsible for the content you post and send. You confirm that you have the right to share it and that it does not violate these Terms or anyone else's rights.

6. Community Rules and Prohibited Conduct

Givaro lets you message other members and share posts, comments and photos with your circle. To keep Givaro safe for everyone, you agree not to:

  • Harass, threaten, bully or intimidate anyone
  • Post or send content that is hateful, sexually explicit, violent, or that promotes illegal activity or self-harm
  • Send spam, scams, phishing links or unsolicited commercial messages
  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity
  • Share another person's private information without their consent
  • Use Givaro for any unlawful purpose or in violation of applicable laws
  • Attempt to reverse engineer, decompile, or extract the source code of any part of the app
  • Upload or transmit malicious code, viruses, or harmful content
  • Interfere with, disrupt, or circumvent the security or functionality of Givaro
  • Use automated tools to scrape, harvest, or collect data from the app
  • Create accounts for others or transfer your account to anyone else

7. Reporting, Blocking and Enforcement

You can block any member from a chat or from their profile. A blocked member cannot message you, see your profile, wishlists or posts, or send you a friend request. You can manage blocked members in Settings → Blocked Accounts.

You can report messages, posts, members and contacts from inside the app. Givaro reviews reports and may remove content, restrict features, or suspend or permanently close accounts that violate these Terms, with or without notice. We may also report unlawful conduct to law enforcement. Filing false or abusive reports is itself a violation of these Terms.

8. Retailer Links, Purchases and AI Suggestions

Givaro shows products from third-party retailers and may earn a commission through affiliate links when you make a purchase, at no extra cost to you. All purchases are made on the retailer's own website under the retailer's terms. Givaro is not the seller and is not responsible for pricing, availability, shipping, returns, or product quality.

Gift suggestions in Givaro are generated with the help of artificial intelligence and may be inaccurate or out of date. Always check product details, prices and availability on the retailer's site before buying.

9. Rewards and Referrals

Givaro may offer rewards points and referral bonuses. Points have no cash value, cannot be transferred or sold, and may be adjusted or withdrawn if they were earned through fraud, abuse, or a violation of these Terms. Givaro may change or end the rewards program at any time.

10. Aggregated & Anonymized Insights

Givaro may analyze user activity within the app to generate aggregated, anonymized insights that help improve the platform and may be shared commercially. These insights may include:

  • Gifting trends and seasonal patterns
  • Category and product preferences
  • Behavioral clusters and taste segments
  • Taste Graph™-level data (for example, "People with X style preferences tend to favor Y gift categories")
  • Anonymous demographic and interest groupings

All such insights are created in a manner that cannot identify any individual user. Givaro applies industry-standard anonymization and aggregation techniques before any insight is used externally.

Givaro does not sell personal information. Aggregated and anonymized insights may be shared with brands, retailers, analytics partners, or other commercial parties for business and research purposes.

Opt-Out: You may opt out of contributing your anonymized activity to these insights at any time through Settings → Data Preferences. Opting out does not affect your access to Givaro's features.

11. Third-Party Services

Givaro integrates with and links to third-party platforms, services, and data sources, including retailers, Sign in with Apple and Google, and the service providers listed in our Privacy Policy. These are governed by the terms and privacy policies of the respective third parties. Givaro is not responsible for the practices or content of any third-party service.

12. Intellectual Property

All content, branding, algorithms, the Taste Graph™ and Givaro Brain™ systems, design elements, user interface, and underlying technology that constitute the Givaro platform are the exclusive intellectual property of Givaro LLC and its licensors. Nothing in these Terms grants you any ownership rights in Givaro's intellectual property.

13. Termination

You may delete your account at any time in Settings → Delete Account or at givaroapp.com/delete-account.

Givaro reserves the right to suspend or permanently terminate your account at any time, with or without notice, if you violate these Terms or engage in conduct that is harmful to Givaro, its users, or third parties. Upon termination, your right to access the app ceases immediately. Sections 5, 8, 12, 14, 15 and 16 survive termination.

14. Disclaimer of Warranties

Givaro is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. Givaro does not warrant that the app will be uninterrupted, error-free, or free of harmful components.

15. Limitation of Liability

To the maximum extent permitted by applicable law, Givaro LLC and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or other intangible losses, arising out of or related to your use of the app. Our total liability for any claim relating to Givaro is limited to the greater of the amount you paid us in the past twelve months or fifty US dollars.

16. Governing Law

These Terms are governed by the laws of the State of Arizona and applicable United States federal law, without regard to conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Maricopa County, Arizona.

17. Changes to Terms

Givaro may update these Terms at any time. Material changes will be communicated through the app or via email, and the "Last Updated" date above will change. Your continued use of Givaro following notification of updates constitutes your acceptance of the revised Terms.
